Which of the following most accurately describes the problem?

• The Transport Tribunal has reserved its decision on the appeal by Spinks Interfreight Ltd, which was heard in London last week. The appeal was against a decision of the Northern LA, Mr J. A. T. Hanlon, who had refused an application for an operator's licence aUthorizing 50 vehicles and 88 trailers. The grounds for the refusal were that the applicant was an unfit person and this was based on the fact that the directors had been named in an operator's licence held by Spinks Transport Services, a subsidiary of Amalgamated Transport Services when ATS went into liquidation (CM March 17).

Mr Richard Yorke, QC, appearing for Spinks, stated that the LA should have named the director or directors whom he considered to be unfit and that it was unfair of him not to have done so.

Spinks' advocate attributed the failure of ATS to Allison's Freightlines, another of the group's subsidiaries. He said that there were no grounds for imputing maladministration on any of the former directors of ATS. Mr Yorke said that there was disagreement among the three liquidators about the inter-company debts.

Sir Wilfred Morton, one of the members of the Tribunal, requested that Spinks should be required to produce figures showing how much was owing to outside creditors. Earlier this week the Tribunal was still awaiting the production of the figures without which a decision cannot be reached.
