Which of the following most accurately describes the problem?

Applicants for a standard (hire and reward) 0-licence must satisfy the LA that they are "professionally competent" under the Goods Vehicles (Operators' Licences, Qualifications and Fees) Regulations 1984.

To do this they must have a transport manager, who is defined as someone who has continuous and effective responsibility for the management of the transport operations of the business.

The transport manager must be qualified — this usually means holding a Certificate of Professional Competence — and be of good repute.

However regulations came into force in November 1991 which did away with the

need for a transport manager to be full-time. The previous legislation had been criticised as being unfair to owner-drivers.

In such a situation the LA would find out seven key details about the proposed parttime manager, says West Midland LA John Mervyn Pugh.

These are: • How many hours he works.

• How many employers he has.

• How many vehicles he is responsible for.

• The distance between each of his operating centres.

• His duties: is he also a driver and fitter?

• Where he lives.

• If he is of good repute.
