Which of the following most accurately describes the problem?

ARULING that by' reason of his right to carry agricultural produce for other people in his locality, a Clicence holder can transpOrt livestock, except for cattle dealers, was given by the Yorkshire Deputy Licensing Authority, at Hull,. last Friday.

The point arose during the hearing of an application by Mr. J. Leighton, market gardener, of High Street, Barnby, for a. B licence in substitution for an existing C licence, Mr. F. G. Bibbings, secretary of A.R.O. York/

shire Area, for the applicant, explainer that Mr. Leighton was seeking permis sion to carry the following classes o

good.s : —Road and building plant an( materials, light goods, and furniture and household effects within 20 mile of Barnby Post Office, livestock withir 40 miles, and agricultural produce ark farm requisites within 55 miles.

Mr.. Merritt, for the L.N.E. Railway Co., suggested that under Section 1 (5)

(c) of the Act, the applicant was entitled as a market gardener and Clicence holder to carry for any person in business in the locality, not only agricultural produce in the generally accepted sense of the term, but also livestock. The Deputy Licensing Authority, who is a barrister, accepted this submission.

Mr. Bibbings, who remarked that this was • the first time that issue had been raised in the Yorkshire Area, said that if the Del:Ray Authority took the view that within the meaning of the Act agricultural produce included live stock, he (Mr. Bibbings) did not desire to proceed with the other part of the application. Mr. Leighton would be perfectly satisfied, to be able to carry agricultural produce, including livestock, under his C licence.

This course . was aimed to by the Deputy Authority, who finally ex

pressed the view that under his C licence, Mr. Leighton could carry livestock for farmers and stockbreeders in his locality, but not for cattle dealers.
