FODEN and the owners of one of their vehicles have between them paid out £20,000 agreed damages following an accident five years ago in which the driver died and his passenger lost his legs.

The accident happened in November 1971 when the Foden artic was being driven by the company's service engineer after a brake fault had been reported.

As he braked, the load of four 4-ton concrete pipes shifted and one rolled on to and over the cab. The accident killed the driver and the passenger, ARC Concrete transport clerk Mr Michael Ruane, lost both legs.

The damages were split between Foden's of Sandbach Cheshire, and ARC of Stanhope Gate, London. They were awarded without prejudice. Mr Ruane lost his left leg at the hip and his right at the knee. The pipes had been chocke< on the trailer but were no secured by ropes or chains am Mr Ruane had been aware o how the load was secured.
