Which of the following most accurately describes the problem?

• A Birmingham haulier, Mr Ernest Percy Lloyd of Shady Lane, Great Barr, who pleaded guilty by letter to 16 offences concerning overloading when carrying solid fuel, was fined a total of £330 by Coleshill magistrates last week.

Mr W. Whitehead, prosecuting for the West Midland Licensing Authority, said the defendant operated two vehicles the gross permitted weight of each being 18 tons. As a result of information received drivers' records and delivery notes were examined and they revealed that on numerous dates in July and August, 1972, the defendant and a driver drove the vehicles when overweight.

A West Midland traffic examiner, Mr J. Hicks, produced the records and said he interviewed Mr Lloyd in October, when he produced plating certificates showing the maximum permitted gross for both vehicles was 18 tons. When shown the records relating to the overloading, Lloyd had nothing to say except that he had sacked the driver because he had continually disobeyed instructions not to overload. It was pointed out to Lloyd that he himself, had been the driver on a number of occasions.

The magistrates imposed fines of £30 each on six charges where the overload exceeded two tons and £15 on the remaining 10 all of which exceeded one ton. Lloyd was also ordered to pay £4 costs.
