• Mr P. F. Lackey, a Liverpool furniture remover, had his application for an additional five vehicles refused at a public inquiry in Liverpool on Monday and his hearing under Section 69 adjourned pending the production of maintenance records and proof that regular maintenance inspections were being carried out.
The court heard that when a vehicle examiner visited Mr Lackey a new vehicle which he was then operating was found to have a number of serious defects and was issued with an immediate prohibition notice. The examiner went on to tell the LA that at the time Mr Lackey stated that the vehicle was being regularly inspected by a local garage but the garage later denied this.
In his evidence Mr Lackey claimed that the garage was maintaining his vehicle and keeping records, and said that a "mistake must have been made".
Mr Hayward adjourned the hearing to allow Mr Lackey time to obtain a letter of confirmation from the garage and a specimen of the vehicle's maintenance records.
