Road Movement Services (Scotland) lost its licence for 20 vehicles and 20 trailers after McFarlane decided the company "thought nothing of breaking the law". He also disqualified the Milnathort-based company and its principal director Allan Morton from holding or obtaining a licence for five years.

Explanations had been offered by four drivers for offences including the falsification of tachograph records, and against the company for not having a tachograph fitted properly—but McFarlane was not convinced that the company had taken the matter seriously.

There appeared to be little or no system for effectively disciplining drivers who broke the law, he said, and a trend had been established of unlawful interference with tachographs and speed limiter devices.

McFarlane did not accept that a driver involved in an accident on the M6 Motorway had fitted an interrupter switch himself.

It had been claimed that there was no benefit to the company, but McFarlane did not accept that either, as the vehicle would more readily be available to the company for more work.

He decided that the company no longer met the requirement to be of good repute.
