A DURHAM LORRY driver who was convicted of criminal damage and causing actual bodily harm in 2002 has been granted an 0-licence.
Michael Franks, trading as MA Franks and Sons, had sought a new national licence for two vehicles before North Eastern Traffic Commissioner Tom Macartney at a Leeds public inquiry. Franks said he was currently running under interim authority with one vehicle, carrying bricks and blocks for building sites. He would be starting in general haulage in two weeks and hoped to progress to two vehicles in a year's time The TC remarked that criminal damage and ABFI did not give the right image in a professional industry.
Asked about the convictions,Franks said what had oecurred had been fuelled by alcohol. The trouble started between his father and the son of the man he ended up fighting. He went to their house to see what was happening and "everything went pear-shaped". The criminal damage occurred when a wall was knocked over in the fight. He was held mainly to blame, but there were no longer any problems between the families.
Granting the licence after Franks agreed to attend an operators' seminar, the TC warned Franks that he would be particularly concerned if there were further convictions for offences involving violence or alcohol.
