Which of the following most accurately describes the problem?

• The licence held by Philip Stanford of Kidderminster, trading as Wolverley Plant Hire, has been renewed until the end of November 1995. It was renewed after West Midland LA John Mervyn Pugh heard that fly-tipping fines and costs of £19,145 had been paid.

When Stanford first appeared before the LA, in May 1993, he was warned that if he continued to park vehicles other than at his authorised operating centre, his licence was likely to be revoked.

Those proceedings were adjourned for Stanford to pay the fines and costs. The LA considered that an arrangement to pay at the rate of £250 a month threw doubt on his financial standing (CM27 May-6 June 1993).

When the case came before the LA again, in May this year, Stanford applied to renew his nine-vehicle/threetrailer licence, subject to environmental conditions. The application was opposed by residents living close to one of his two operating centres. Adjourning the proceedings, the LA warned that if the fines and costs

were not paid by 5 September Stanford's licence would be revoked and he would be disqualified from holding or obtaining an 0-licence (CM 19-25 May).

When the hearing was resumed, evidence was produced that the balance of £14,895 had been paid by bankers' draft. The LA was sitting with DOT financial assessor John Kelly, who said that draft accounts showed a considerable improvement since March 1993.

Renewing the licence until 30 November 1995, Mervyn Pugh warned Stanford that if he broke any of the conditions on his licence it would be revoked. He required audited accounts for 1993/94 to be delivered to the traffic area office within 28 days.

Directing that the renewal of the licence be considered at a further public inquiry; the LA said that he would require final accounts for the current year at that inquiry
