Fines and costs of f 187 were imposed on a 'reston company, and one of its drivers, liter they had each pleaded guilty to one harge in connection with the keeping of Myers' records, by the Layland, Lancashire, nagistrates recently.
Driver Mr Frank Garner, of Liverpool Old Hoole, near Preston, was charged with failing to keep a current record on May 15, 1972. His employers, Gibson Cooper Ltd, which trade as Tetrad Associates, of Bloonfield Mill, Southgate, were charged with causing and permitting Garner's offence.
Prosecuting for the North Western LA, VIr J. S. Lawton said the offences came to Light following a silent check conducted by DoE staff at Newport Pagnall on Ml. 3arner's vehicle was noted yet when the driver's records for that day were subse4uently examined they purported to show that the vehicle had solely been engaged on local work in and around Preston. The record had been filled-in in such a manner that no offences were obvious and but for the silent check they would have been undetected.
Mr M. J. Craig, a DoE traffic examiner, said the company had been warned on previous occasions about the manner in which its drivers' records were being kept.
In a letter to the court the company said, in mitigation, that the offences had arisen owing to an emergency caused by a vehicle breaking down in southern England. Garner's vehicle was sent down to assist and in the panic the drivers' records were overlooked.
The magistrates fined the company £125, with £12.14 costs, and Garner £40, with £10 costs.
