Which of the following most accurately describes the problem?

• A hazchem haulier has had his 31-vehicle licence renewed even though a neighbour alleged that nitric acid had been discharged into drains four years ago.

Granting the application from Norman Lewis (Tankers) of Goole, North Eastern Deputy Licensing Authority Brian Horner discounted the representation made by the neighbour Brian Dennis of Weelands Road, Helsall.

Dennis said that he was concerned about safety standards regarding the washing out of tanks. One of the conditions of the operating centre's planning consent was that there would be no tank cleaning on site.

Horner upheld arguments from Stephen Kirkbright, defending, who said that Dennis's representation was invalid because there was no evidence to show that the use and enjoyment of his property was being affected by the operation.

Norman Lewis director Gary Lewis said a professional tank cleaning service was used four miles away from the company's depot. The only tank cleaning that took place at the depot was external cleaning.

Horner said he was satisfied that the regulations covering the cleaning of tanks had not been flouted!.
