II Operators leasing their vehicles will be legally liable for the Transport for London congestion charge when new legislation is introduced in the autumn.

IL had originally denied leasing companies the right to transfer liability where contracts are for longer than six months. But after intensive lobbying by the British Vehicle and Leasing Association the Department for Transport announced the U-turn last week.

Literally weeks before the congestion charge was introduced in February the BVRLA was told that as the registered keepers of vehicles, its members would be responsible for paying the penalties for failing to pay the congestion charge, and not the users of the vehicles.

A spokesman adds: "Until then, the BVRLA understood if a customer was fined for not paying the congestion charge the BVRLA member would be notified as the registered keeper. We would then tell fit who to contact to get them to pay the charge. Until legislation is introduced BVRLA will continue to press IL for an interim scheme."
