Which of the following most accurately describes the problem?

A Norfolk firm has had its disciplinary inquiry adjourned so it can be heard at the same time as similar proceedings involving another local firm, Brandon-based Arrowpak (Transport & Warehousing).

Vincent McGrath and Glen Bailey, trading as Europlus Transport, of Thetford, had been called before the Eastern Traffic Commissioner Geoffrey Simms in Cambridge.

Traffic examiner Geraldine Wright said last August she visited the firm, which held an Operator's Licence for three vehicles. McGrath told her Europlus Transport no longer existed as its licence had been withdrawn. The contracts of its 36 drivers were terminated and drivers had been hired for Arrowpak. Wright said that according to records the licence was still live.

McGrath was only able to produce 262 tachograph charts with a number missing. There were also a number of drivers' hours offences and possible false records.

Traffic examiner Richard Mirttimer said that Arrowpak told him that it had been using agency drivers supplied by Europlus Aviation and that Europlus Transport was working for them as a subcontractor. He had no evidence linking them, other than what he had been told.

McGrath said that the two Europlus vehicles were used by Europlus Aviation to carry out work at the behest of Arrowpak. Europlus Aviation had never held an 0-licence.

The four vehicles he had hired had been used by Arrowpak and driven by Europlus Aviation drivers so he thought they were used under Arrowpak's licence.

Europlus Transport also had its own work and the 262 tachograph charts produced related to this. The vehicles were parked up after the County Council had objected to the use of their yard and had said they wanted the licence withdrawn.
