The South Wales Traffic area warns: Failure to attend inquiries public inquiries will result in the application being refused for want of prosecution save in exceptional circumstances.
Moreover, any requests for applications to be taken out of a hearing list for public inquiry for re-listing at a later date, must be made at least five days before the date of the public inquiry and adequate reasons given to justify the request.
In the course of judgment, the Transport Tribunal stated as follows: "We have frequently had occasion to comment adversely upon the disadvantage of putting in financial documents without giving any proper opportunity for their examination. As we have said before, copies of such documents should be applied to the Licensing Authority at least seven days before the public inquiry", and indicated that such documents produced for the first time at a hearing before a Licensing Authority could be regarded as being of little value.
The Licensing Authority requests that a copy of any financial or statistical evidence which is to be used at a public inquiry in support of an application shall be forwarded to this office* at least seven days prior to the public inquiry.
