A traffic examiner had reported that vehicles had been operated when there was no 0-licence in force and that a few of the vehicles were registered in the name of City Waste rather than Bilston Skip Hire.

Sole director Raghbir Singh said he had bought City Waste's skip hire business. City Waste director Ian Smith had told him he could trade under their 0-licence for 12 weeks. Singh had received a letter from the Traffic Area Office (TAO) in July which he had misinterpreted as saying he could operate under the old licence. He was never made aware that the City Waste licence had been revoked.

Bilston Skip Hire Services had eight vehicles in possession and was currently operating three vehicles on City Waste contracts. Singh had spent about £ 100,000 on the business and bringing the vehicles up to scratch.

The TC pointed out that a letter from the TAO dated 26 June said the company's interim licence application was being considered and made it plain that the company could not operate in the meantime.

Although not happy about what had occurred, the TC granted the company a licence for four vehicles after receiving an undertaking that the Smith brothers and Singh's brother Baldev Singh,who had had a PSV 0-licence revoked, would not be involved in running the business.
