Warren Warehousing & Distribution (Southern) of Charlton, London has pleaded guilty to using a vehicle when the speed limiter was not functioning.

Wigan magistrates heard that a 38-tonne artic belonging to the company was stopped in a check at Goose Green on 8 July. When the driver produced his tachograph charts to a traffic examiner, they showed speeds in excess of 120km/h. When questioned the driver said that the speed limiter was not working.

Excessive speeds were shown on every day going back to 1 July—the charge before the court was a specimen of eight individual offences.

Managing director Derek Warren said the company was continually checking the tachograph charts and when excess speed was noticed the vehicles were booked in for repair. When the driver reported the incident the speed limiter was booked in and repaired.

In a letter to the court the company said that while it monitored its vehicles for defects, this particular vehicle had slipped through. The court was asked to take account of the fact that this was new legislation for the drivers to get used to.

The magistrates fined the company £1,000 with £75 costs.
