Stephane Aineto died in the :arly hours of a Sunday morning in July last year when le fell under the wheels of a lustcart, which had passed a o-entry sign to enter a pedesrianised area of East Street in 3righton. it was being operated iy waste disposal firm Sita who an the council contract. In December 2001 the City coroner ruled a verdict of accidental death. However, the family is now calling for an inquiry into the coroner's inquest claiming that much of the potential evidence that should have been explored in the original investigation was ignored. This includes that the inquest was held without a jury and without the involvement of the Health and Safety Executive, which is now holding its own criminal investigation.
Solicitor John Halford of the Public Law Project, who is representing the case, says: "A death such as this calls for a thorough investigation followed by a thorough inquest before a jury, with input from the Health and Safety Executive on questions such as the safety of the vehicle involved and working practices. The inquest into Stephane's death, in my view, fell far short of these standards."
Brighton and Hove City Council has declined to comment.
