Trucks were on the licence of a failed company.

A FIRM THAT operated illegally for more than eight months following the dissolution of one of its limited companies has been banned from holding an 0-licence indefinitely.

West Midland Deputy Traffic Commissioner Jim Astle was considering action against the eight-vehicle licence held by Wolverhampton-based OST Distribution, together with an application for a new licence for four vehicles and two trailers by Telfordbased SY Logistics. The sole director of both companies was Simon Yeadon.

The DTC said the cases were first listed for public inquiry on 26 January. but Yeadon failed to attend. He later claimed he had made a mistake about the date and the hearing was adjourned to allow him to attend. However,Yeadon again failed to turn up.

In September, a vehicle was stopped in a check and given an S'-marked prohibition. lhe vehicle was specified on a licence held by OST Distribution. which was dissolved in January 2009, although it was registered to SY Logistics. As a result the OST Distribution licence had lapsed, and the vehicle stopped in September was being run without an 0-licence.

An application for an 0-licence by SY Logistics was refused in May 2008, something that Yeadon failed to disclose in the application form.

Seven vehicles that were on the OST Distribution licence were all currently registered to SY Logistics. Three were specified on the OST licence after the dissolution of OST Distribution. The DTC concluded that they were being operated without an 0-licence.

There was no evidence before him from either company and there was no evidence that either company met the requirement to be of appropriate financial standing.

The DTC revoked the licence held by OST Distribution on the grounds that it no longer satisfied the requirements to be of good repute and of sufficient financial standing, He refused the application for a new licence by SY Logistic. not being satisfied that it was of the appropriate financial standing or of good repute. He disqualified OST Distribution and Yeadon from holding or obtaining an 0-licence in any Traffic Area indefinitely.
