Which of the following most accurately describes the problem?

• Spanish-owned FOCSA (Services UK) has beaten French-owned Onyx UK and the British-owned AAH Environmental Services to a four-year street cleaning contract with Derbyshire Dales District Council.

The contract had been operated by DDC's direct service organisation, and some job cuts look likely. Unison, the combined Nalgo, GMB and Nupe union says Transfer of Undertakings legislation is being applied to the contract, which is worth a total of just over £2.6m. Manchester-based FOCSA already operates five street cleaning contracts for local authorities, four refuse collection contracts, and one in Stockport which combines the two.

The EC's Public Services Directive, which came into force on 1 July of this year, says that service contracts over £141,000 and likely to go to outside contractors, must be advertised openly throughout the EC.

AAH Tyler Waste Management already operates the refuse collection contract for DDDC.
