EXTRA work that Simonstone Transport
Ltd., of Burnley, Lancs., might gain through the expansion of one of its customers was likely to be more than offset by a fall in its work for another customer, according to the Transport Tribunal.
The Tribunal were giving their reasons in writing this week for their dismissal of an appeal by Simonstone (COMMERCIAL MOTOR, October 14) against the decision of the North Western deputy LA refusing its application to add four vehicles to five company vehicles already operating on an A licence. Added the Tribunal: "The deputy LA in coming to his decision took into account the previous conduct of the appellants as hauliers and stated that Mr. Cyril Hanson, their managing director, had had little regard for his normal user and that he should be required to comply strictly with it, as somewhat amended, before seeking more vehicles. Having regard to the fact that we do not consider that the case was made out on its merits for any increase in the A-licensed fleet at the present time, it is unnecessary for us to express any view with regard to the appellants' previous conduct."
