Which of the following most accurately describes the problem?

STATING that the Transport Arbitration Tribunal was not satisfied that the goodwill of D. and H. Cuff, Ltd., Blandford, would have fetched any sum if sold in the open market, Mr. C. Montgomery White, Q.C., president, announced, last week, that total compensation ' for acquisition would 'be fixed at £9,906.

As reported in "The Commercial Motor" on March 7, the company claimed £4,452 for goodwill. In the three years before acquisition by the Road Haulage Executive the net profits, before making any allowance for directors' fees, had, it was stated, declined from £1,134 in 1947 to £319 in 1949.

An application for payment of costs by the R.H.E. was made by the appellant's representative, who said that D. and H. Cuff, Ltd., had done a service in raising an important principle concerning goodwill.

• Mr. Montgomery White: "There was a question of principle, but as you did not succeed in establishing the facts which were necessary to go on to decide that question, there will be no order as to costs."
