• The defence costs of Sutton & Son (St Helens) and one of its drivers were paid out of public funds when St Helens Magistrates dismissed allegations of using a vehicle with dangerous brakes, and of a series of tachograph offences, because summonses were "fatally flawed".
Driver David Fitzgerald was accused of failing to use a tachograph chart and using a vehicle with dangerous brakes. The company was accused of a similar brakes offence and of 24 others including allowing drivers not to use mode switches, and failing to use tachographs properly.
