• An application to substitute for a smaller vehicle a larger capacity one was contrary to a Transport Tribunal ruling (CM April 5) said Mr. J. A. T. Hanlon, Northern LA, in Newcastle on Friday. Salkeld Bros. (Transport and Plant) Ltd., Consett, was applying to delete a fourwheeled tipper of 4 tons 6cwt on one of its A licences, which was not revoked earlier this year and add an eight-wheeled tipper of 8 tons 1cwt.

"The Transport Tribunal on appeal said that no new facilities should be granted beyond what the applicant had on the basis of the appeal. I think it is contrary to their decision to suspend 10 vehicles from this applicant company, to affect a further grant.

"Irrespective of need, they said this company should be reduced by 10 vehicles for a year. I would take it thatto further this decision effectively, it is the duty of the Licensing Authority to see that they do not get any increases in unladen weight during that year, otherwise it loses its effect", said Mr. Hanlon.

He further pointed out that the A and B licences issued after the Tribunal's decision were dated April 10 '1968 which was after the variation applications being considered now, were submitted. Thus the variations were invalid and would have to be republished.
