Borzellieri, who held a licence for four vehicles, was called before Eastern Traffic Commissioner Geoffrey Simms because of his maintenance record, breaches of the drivers' hours rules, the unauthorised operation of trailers and the use of unauthorised operating centres.

Vehicle examiner Christopher Swaisland said that between May 1996 and December 1998 one delayed and three immediate prohibitions had been placed on Borzellieri's vehicles. Bor II icri admitted hauling trailers belonging to other operators because he thought he did not need a trailer authorisation on his own licence.

PC Richard Frater of the Metropolitan Police said an examination of 74 charts revealed 47 offences. Of particular concern was that 24,217km out of a total of 48,012km covered by two vehicles remained unaccounted for.

Asked whether he used the Waltham Abbey operating centre, Borzellieri said that sometimes he did and sometimes he didn't. The missing kilometres were a result of casual drivers failing or refusing to hand in their tachograph charts, he added. Asked why he had not withheld payment to persuade the casual drivers to hand in their charts, Borzellieri said they were "rough people".

Holding that Borzellieri was not of good repute, Simms said he attached great importance to adherence to authorised operating centres. The drivers' hours and tacho offences were extremely serious and he did not consider that Borzellieri had the ability or capacity to be an operator.
