• Bootham Removals has been ordered to pay 21,725 compensation for unfair dismissal to a driver it sacked for refusing to pay a £1,200 overloading fine imposed on the firm.
A Leeds industrial tribunal heard that Anthony Magin was driving one of the company's smaller vans last November. The load was substantially over the permitted weight, but Magin failed to telephone the firm's office in York for instructions.
On the return journey his vehicle was stopped by police and found to be 40% Over the limit. In April Magin was fined £300 and the firm ,21,200 for the overloading offence.
The tribunal said that if the firm had thought there had been a serious breach of its instructions, it should have taken action at the time.
