The licence held by Trannent, East Lothian-based Derek Heaney was revoked with immediate effect, and Heaney was disqualified from holding an 0-licence for two years, after he twice failed to attend an Edinburgh disciplinary inquiry Heaney who traded as Capital Access with a licence for two vehicles, had been called before Scottish Traffic Commissioner Michael Betts because of concerns about his maintenance record and his financial standing.
After hearing evidence from a vehicle examiner about various prohibition notices and unsatis factory maintenance investigations in January and March, the IC found that Heaney had failed to make proper arrangements to ensure that his vehicles were properly maintained and that drivers reported safety defects as soon as possible.
He aiso found that Heaney had failed to make proper arrangements to keep his vehicles maintenance records for 15 months and to make them available on request.
The TC heard that Heaney had failed to notify the Traffic Area Office that his father was no longer involved in the business, and that his operating centre was not authorised.
Commenting that Heaney had failed to supply the financial information requested in the letter calling him to the first public inquiry, the IC said he was no longer satisfied that Heaney had sufficient financial resources to ensure adequate maintenance.
