ENT RECOVERY operator lavid Rackham, has said he rill appeal if he loses an unfair ismissal case heard at Ash)rd, Kent, last week after one f his drivers who was involvd in an accident ceased to irork for him.

At the hearing, 26-year-old klex Fowie claimed unfair lismissal against Mr Rackham tfter he was involved in an iccident with a vehicle beonging to Auto Renovations, Ir Rackham's Strood-based rompany.

Mr Fowie, who it is said, had iigned a form to say that he would pay any damage caused :0 company vehicles involved in accidents while he was driving, claimed there was oil on the road and he could not avoid the accident.

The company operates a scheme where all employees sign a form saying that they will pay any damage to the company vehicles under any circumstances.

This week Mr Rackham told CM that he would be surprised if he lost the case. "We proved that he was lying, absolutely conclusively. The Tribunal didn't like the scheme we operated," he added.

"If a driver has an accident, then the insurance company says we will insure the rest of your drivers but not this one who had the accident.

"The pay-up scheme is a deterent. I only make them pay parts' costs," said Mr Rackham.

"The Tribunal has got the impression that my scheme is illegal, but if my trucks don't pay, then I'll send the whole lot to the waIl," Mr Rackham threatened.

Mr Rackham said that he will appeal against the findings of the tribunal if the court goes against him. Now he has to wait for the decision which will be announced later.
