Which of the following most accurately describes the problem?

• Leicester haulier Bromley Brothers and Sons (Kibworth) was given a final chance to put long-standing maintenance problems right when it had its Operator's Licence suspended for three months.

Eastern traffic commissioner Brigadier Compton Boyd said he had considered revoking the licence but would give the company and its sole director, Kelvin Capell, one more chance.

However, if Capell had to appear before him again he would probably be banned from ever holding a licence again.

The public inquiry was called after the company's only vehicle was given an immediate prohibition on 13 February this year. A subsequent check of its operating centre at Station Yard, Station Street, Leicester found there was no regular inspection of vehicles and no driver defect reporting system.

A recent Vehicle Inspectorate check on 5 June found the company had appointed a trained mechanic to service the vehicles regularly and there was a driver defect reporting system now in place.

Suspending the licence from 17 June to 17 September, Brigadier Boyd told Capell: "What I expect you to do in those three months is to concentrate on your responsibilities so that you can pick up from where you are now."
