Under Section 184 of the Road Traffic Act 1960, the NloT has powers to stop a vehicle and, if it is considered unsafe, can prohibit the use of that vehicle for the carriage of goods. It has no power to stop the vehicle being unloaded and driven away.

The new scheme, which wilt be legislated under Section 16 of the Road Safety Act 1967. gives the MoT the necessary power to prevent a vehicle served with an immediate prohibition being driven on the road, loaded or unloaded.
