Which of the following most accurately describes the problem?

A new company has risen from the ashes of failed operator Ryack Transport taking on its customers and staff. Chris Tindall reports.

A FREIGHT FORWARDER that began trading when Cheshirebased Ryack Transport went into administration owing thousands of pounds, has defended its decision to poach many of the failed company's customers, staff and subbies.

Businessman Jason Arnold, who has no links to Ryack Transport. has bought dormant company Ryack Logistics and employed a couple of Ryack Transport's staff, including Michael McGuire.

McGuire, now Ryack Logistics traffic manager, says its policy has allowed customers of debt-ridden Ryack Transport to continue trading.

He says he is owed wages from Ryack Transport, but believes the beleaguered company's director, Keith Ripley, is doing all he can to claw back money for creditors.

"Jason's seen an opportunity there to continue with customers," says McGuire. "It's totally different management. Personally, 1 don't see anything wrong with what has happened." McGuire claims some of Ryack Transport's subbies haven't sent their PoDs to the administrators, which is causing problems retrieving money.

He adds:"Keith Hopley is working with [administrator DTE] so that the subbies will get paid. He didn't have much experience in the industry, which may have been his downfall.

Hopley's Ryack Transport, based in Northwich, went into administration on 12 June. Accountants from DIE Leonard Curtis are trying to collect all money owed to it (CM 29 June).

A DTE spokeswoman says "cash flow problems and had debts" were the reason for the company's failure. One creditor. Brian Cruickshank, says he is owed £17,000, while Sally Taylor, for Taylor'sTransit Services,says she is owed nearly £1,200.
