WHAT'S ON THE TABLE

UK: Under BSAU 217 the maximum permitted tolerance is 3.2km/h (2mph).

EC: The directive states that a limiter must be set in such a way that a vehicle cannot exceed 90km/h although the maximum speed on the device "shall be set at 85km/h". That seems to translate to a tolerance of 51un/h with a 90km/h limit.

WHAT HAPPENS NEXT

Clearly there is a potential conflict between what the UK's C&U regs will allow and what the EC will accept. For example, if UK tolerances were applied to the EC directive which comes into force in 1994, the effective speed limit would be reduced from the planned 90km/h (56.9mph) to 88.2km/h (54.8mph). Not surprisingly the trade associations are asking the DTp what it plans to do on the tolerances.
