Which of the following most accurately describes the problem?

• An Essex truck driver and his employer, J Loveric Transport, have been charged with a series of hours and tachograph offences.

James Thomas of Whitehorse Avenue, Hilstend, near Colchester is accused of 17 offences of making false tachograph records; 17 offences of failing to make entries; 12 of taking insufficient rest; and two of exceeding 10 hours driving in a day.

Loveric has been charged with 14 offences of using a vehicle with illegal recording equipment and permitting Thomas to take insufficient daily rest and exceed his 10-hour driving limit.

For Thomas, Tony Wetmysee opposed any adjournment, saying that his client had already had to travel to the court in Leigh from Essex, But the magistrates were told that the company's defence was not ready and the prosecution said it wanted both the driver's and the company's cases to be dealt with together.

The hearing was adjourned until January.
