• Overloading fines against Llannvst-based Cawley Bros have been reduced from 21,200 to 2300 at Knutsford Crown Court after evidence revealed that the load had shifted forward during the journey. Mr Recorder Argyle QC also quashed fines totalling .2200 imposed on the driver, Eifon Roberts, substituting them with absolute discharges.

The court heard that when the vehicle was check-weighed it was discovered that both the permitted gross and second axle weights had been exceeded.

For the defendants, Jonathan Gosling said that Roberts had check-weighed his artic before leaving Burley Hill quarry and the train weight had been 38 tonnes. Evidence had been given that the load had shifted forward, and that was the probable cause of the overloading.

The Recorder said that he was satisfied that Roberts had done everything possible to ensure the legality of the load and he was not in any way to blame. However, the position of Cawley Bros was different, he said, but he felt that the company's fine should be reduced in view of the mitigating circumstances.
