Which of the following most accurately describes the problem?

• The takeover of two A licences and a 8 licence operated by Joseph Walsh (Darwen) Ltd. by a new company, Walsh Transport Services Ltd., has been granted by the North Western LA, Mr. C. R. Hodgson. At the inquiry (CM December 6) he was told that Hawtin Industries Ltd. had acquired the share capital of the Darwen haulage company and had set up a new one whose directors included officers of Fred Davis (St. Helens) Ltd., another transport firm within the group.

The LA was urged to give a decision because, it was pleaded, any proceedings regarding allegations of forgery made against the drivers of the vendor company were not statutory offences under the Road Traffic Act. section 178, and could not be related to the takeover application.
