was reported as being convicted of failing to keep a record of his private car driving before he commenced his working day. Could you explain how the man's neglect to record journeys by private Cal could affect his driving time?
AAlthough we have not got the full trans
cript of the case in question, the mosi likely explanation is that the person concerner was a director of the business and was alsc driving a goods vehicle for the business and in this case he would be termed as ar owner-driver. As such, any time spent by him driving a car from his home to his depoi or to where his vehicle was parked (We presume this is where the offence was committed) would be counted as work ir connection with his business and shoulc have been recorded on his record.
This situation does not arise in the cast of an employed driver because he is not generally under the instructions of his employe' until he arrives at his vehicle or at his employer's premises and therefore does nol commence work until that time of arrival.
