Which of the following most accurately describes the problem?

THE OWNER of an impounded tractor unit, who claimed it was being used as a recovery vehicle, must wait to see if he has succeeded in winning its return.

Steven Ellis, trading as RI:US Truck Hire, of Kirkby in Ash field, had sought the vehicle's return when he appeared before North Eastern Deputy Traffic Commissioner Elizabeth Perrett.

Traffic examiner Stephen Rymer said police escorted an artic which was driven by Ellis and laden with two tractor units into a check site after receiving information from the Automatic Number Plate Recognition system.

There was a disc in the window which resembled an 0-licence disc but had written on it on hire from Russian Road Freight Services".

Ellis had said the vehicle was owned by Stefan Ivanchenko and was on hire to NRS 24 Hour Vehicle Solutions. The police thought Ellis and Ivanchenko were one and the same, but that was denied by Ellis. Ivanchenko was said to live at a house rented from Ellis's mother, but neighbours had said nobody wa living there. Ellis had claimed Ivanchenko was in till Ukraine and could not be contacted, and that he par owned the vehicle with Ivanchenko.

Rymer told the Deputy TC that NRS's licence hal been revoked earlier this year.

Ellis said he bought the vehicle with Ivanchenkl in January with a view to renting it out. He had sinc bought out lvanchenko's share and the vehicle wa now solely his. At the time it was stopped it was tram porting two disabled vehicles to Southampton. H worked as a self-employed driver for NRS.

Ellis agreed the vehicle was insured in his nain trading as Russian Road Freight Services. He said had originally been registered in Ivanchenko's nam as he had owed him some money.

When he had worked for NRS in the past there ha been no disc in the windscreen and he had been tol the truck was being used on recovery work.

The DTC will announce her decision in writing.
