Malcolm Seward, prosecuting for the Vehicle Inspectorate, said a lorry owned by George Ingram Cooper of West Manningtree, Essex, was inspected at the M6 lorry park, Perry Barr, Birmingham on 1 February. The 38-tonne truck's speed limiter was not working and the tachograph had recorded speeds of more than 90km/h. Cooper admitted the offence and appeared in court with his firm's mechanic.

Cooper told the magistrates his firm operated a system where vehicles were serviced every six weeks and drivers were expected to report any defects. "We cannot do any more than this," he said. "I was not aware the speed limiter was not working. The driver concerned has been reprimanded." Cooper said he had been running his firm since 1964 and employed 28 people. He operated 18 vehicles and had a turnover of more than £1m, he said.
