Which of the following most accurately describes the problem?

• North Yorkshire County Council trading standards department has warned weighbridge operators in its area that refusing to allow drivers to check-weigh axles could leave them open to prosecution for permitting overloading offences Many weighbridge operators have been refusing to allow such checks because they cause delays. Following representations from transport lawyer Jonathan Lawton, the County Trading Standards Officer has written to weighbridge operators in North Yorkshire bringing the problem to their attention.

He warns that some magistrates have supported suggestions that prosecuting authorities ought to start instituting proceedings for such offences.

Weighbridge operators have been requested to allow drivers to check axles on their weighbridges, and to publicise this service.

According to North Yorkshire trading standards every operator has now agreed to allow axle check-weighing if requested by a driver.
