NO ACTION has been taken against a Tarmac subcontractor who operated three vehicles after being issued with three 0-licence identity discs, even though his three-vehicle licence had a condition that only two vehicles be operated at any one time.

Nuneaton, Warwicks-based Gian Singh had been called before West Midland Deputy Traffic Commissioner Roger Seymour: the DTC was also considering an application for a new six-vehicle licence by Bermuda Haulage, of which Singh and his wife were listed as directors.

Singh said he had asked a member of the Traffic Area staff about increasing his authorisation to three vehicles and had been told that he need not apply as he had authority for three vehicles and a third licence disc was issued. The DTC indicated that because of this he did not plan to take any action for breach of the licence condition.

Singh said he was operating three vehicles on a contract with Tarmac. Tarmac had offered him more work and his accountant had advised him to form a limited company. He had applied for interim authority to operate four vehicles and had paid for an interim licence so he had thought he was covered.

He had operated four vehicles until receiving a letter saying that interim authority had been refused. As a result he had sold one of the vehicles. The Bermuda Haulage application was being supported byTannac.

After hearing financial evidence in private, the DTC granted the Bermuda Haulage application on condition that Singh surrendered his existing licence.
