DN THE WAGON in more ways than one, passengers on all Scottish buses, not just contract carriages, will be subject to restrictions on alcohol when going to certain sporting events.
The House of Lords last week 3greed with a Commons amendment to the Criminal Justice Scotland) Bill which extended he alcohol control to all psvlicensed buses and coaches.
Asking for the Bill to be )ccepted, Minister of State for 3cotland Lord Mansfield said that it would be wrong if an operator using a coach to take supporters to or from a match couldn't exercise some control merely because he used some procedural device to avoid falling within the legal definition of "contract carriage". He could do so for instance, by collecting fares separately from the passengers.
it was, said Lord Mansfield, more satisfactory to rely on the purpose for which the coach was being operated as the criterion of whether to apply controls rather than the category into which it happened to fall under the provisions of the Transport Act Another amendment, accepted without comment, defines the operator as the driver if he owns the vehicle or the person for whom the driver works whether under a contract of employment or any other personal contract.
