A new clause added by Transport Minister John Speller to the Railways and Transport Safety RIII, currently making its way through Parliament, says: "In particular, a highway authority are under a duty to ensure, so far as is reasonably practicable, that safe passage along a highway is not endangered by snow and ice."

During January some sections of the M11 were impassable for around 18 hours with drivers trapped in their cabs and cars. The bad weather at the time was accurately forecast.

"This clause will clarify any previous doubts regarding the absolute obligations of both the Highways Agency and local authorities in respect of snow and ice clearing actions. Quite simply in the future they will be legally obliged to take the necessary actions," says Freight Transport Association head of external affairs, Geoff Dossetter.
