for a new icence by Frank and Iris Townend, trading as F E N Townend, and has warned them that they have been operating illegally.
The Townends had applied for a national licence for seven vehicles and trailers, based at Meanwood Road, Leeds.
Whalley said a driver had written to him, making allegations about the maintenance of the vehicles. Vehicle examiner John Fielden said he had examined four vehicles and trailers in October, issuing one immediate and three delayed prohibitions. The defects found were safety-critical items, indicating a lack of preventative maintenance. There were no maintenance records for the trailers.
Frank Townend said he put the driver's letter down to "inside villainy". The business had a turnover of £150,000 to £200,000 a year. Iris Townend said inspections were undertaken by Middleton Commercials and Henburys, but Whalley said they had to stick with the stated contractor, which was Middleton Commercials.
Whalley said a book handed in as evidence of the day-today operation showed that the vehicles had been operated without a licence.
Iris Townend said she had telephoned the Traffic Area and been told that it was alright to continue operating, but Whalley said the Townends had no authority to operate.
Adjourning the hearing to give the Townends time to produce further evidence about their maintenance arrangements, Whalley said he expected inspections to be at four-weekly intervals.
