OVERDRIVE, the contract' driving agency, reports an increase in business following the launch of its new contract which gives added protection to drivers and customers.
Company national manager David Thorley told CM that the contract has received 100 per cent clearance from Overdrive's legal advisers. Under section 92(2) of the 1968 Transport Act, it was assumed that a driver had to be a servant or agent of the Operators' Licence holder.
But under the Victorian precedent of secondment, it was established that a driver need not be an employee to be a servant or agent. Drivers employed by Overdrive can now be paid, even if they are not working.
Overdrive now takes on all of the employment respon sibilities for its drivers, leaving its customers to meet road traffic responsibilities, insurance and record keeping requirements.
Drivers all carry duplicate log books, so that second clients can keep track of the total number of hours worked by an agency driver, and sim plified hours record books are to be used where tachographs are in use.
The company has between 800 and 2000 drivers on its books at any one time.
