• An agreement between . prosecution and defence, led to the quashing of a £200 fine imposed on Mainstream Motors, of Hull, for using a vehicle when the tachograph was not functioning correctly, instead the company was given an absolute discharge at Chester Crown Court. As a result, the company abandoned its appeal against a similar fine for failing to have the required two year tachograph check.

For the Crown, Richard Chamberlain said the company had admitted the offences before the Warrington Magistrates, after a fatal accident in which a driver turned his vehicle over on a motorway slip road. It was possible that a factor in the cause of the accident had been the fact that the tachograph was inaccurate and recording speeds that were 22.94% lower than the actual speed, said Chamberlain.
