Which of the following most accurately describes the problem?

• The House of Clydesdale, a department store operator in Glasgow, had its licence curtailed to 10, as specified, and then to nine for a period of three months from June to August, by the Scottish LA at Glasgow. The company gave evidence that it operated a fleet of 256 vehicles with 10 on 0 licence, the balance being light delivery units.

Vehicle examiner, Mr Samuel Greer, accepted that changes made by the company would assist its maintenance but asked for an assurance that the distribution department would not have first call on vehicles where these vehicles were due for maintenance.

Mr A. B. Birnie the LA, asked whether he was indicating that pressure of use had been too great so that vehicles were not being made available for inspection and Mr Greer said this was so.

Clydesdale gave an assurance that vehicles would be made available to its maintenance department when due and would not be taken away by the store staff.

Mr Birnie said that the operator should have known that undertakings which had been given were not being fulfilled. He had to go on what had happened in the past and had decided to curtail the 10 authorized to nine for a period of three months.
