Which of the following most accurately describes the problem?

• Canterbury Crown Court has cut fines imposed on Brian Yeardley Transport from £1,200 to £800 for two overloading offences. The company appealed against fines of £600 on each of a 21% first axle overload and a 25% gross overload imposed by Sittinglxiurne magistrates.

For Yeardley, Tim Nesbitt said the company's drivers were

instructed to weigh if they had a suspicion that they might be overloaded. They had a European drivers' handbook, which set out the drivers' duties in avoiding overloading offences.

The company had installed axle weighing devices fitted to the air suspension of some of its vehicles which told the driver drive axle weight. Lines had been painted in the trailers to show the drivers where to load so as to avoid axle overloads.
