Which of the following most accurately describes the problem?

costs were awarded to Kenneth Reed, 11 West Road, Bishop's Stortford, against the British Transport Commission at Herefordshire Assizes at Hertford, last week. The claim was the result of an accident which occurred while Reed was employed as a driver by British Road Services.

Mr. John Elton, for Recd, said the • claim was for damages for personal injuries because of the negligence of a fellow employee. On August 22, 1955, • Reed had delivered a load of flour to the premises of Thomas Burton, Ltd., Sawbridgeworth, Herts. After pulling away from the loading bay, he directed another driver named Simmons in backing into the bay.

Simmons asked him to drop the tailboard. As he was -doing so the lorry backed. pinning Reed against the wall. Reed shouted, and the lorry went forward 6 in. but then backed and pinned Reed again, said Mr. Elton.

Reed had received bilateral fractures of the pelvis, with.a double fracture on the left side. He suffered pain when lifting, and had had to give up lorry driving, Henry Simmons, of Bishop's Stortford, denied that he asked Reed to help him. He claimed that Reed was giving signals that were unnecessary, and denied that he asked for the tailboard to be let down or that he hacked a second time.
