Which of the following most accurately describes the problem?

• Two vehicles were removed from the licence of Mr Thomas McMillan of Newton Mearns, after he had appeared before the Scottish LA for the second time this year under Section 69.

The LA had already removed three vehicles from the licence on July 30 for three months and the licence now specified 14 vehicles and five trailers.

Mr McMillan referred to a conviction for a tyre infringement which, he claimed, could have been defended successfully but it was often faster and more economic to admit any such charge rather than go to the expense of a costly defence.

In evidence against the firm it was stated that one vehicle inspected had fractures in the chassis and these had actually been painted over.

Mr H. R. Aylmer, the deputy LA, said that it was disappointing that on this second appearance the standard of maintenance had fallen below its previous level. There could have been an element of bad luck but Mr McMillan had not fulfilled his obligations.
