Which of the following most accurately describes the problem?

• Mr. N. Richards, QC, the Official Referee, awarded damages and costs to J. Sorrell Ltd., wholesale meat importer and exporter, Maidstone. Kent, against W. J. Boyes and Sons Ltd., ERF distributor, Peckham, London, recently.

Mr. Sorrell said that on September 5 1968 a six-wheeled, six-year-old ERF rigid was taken to W. J. Boyes for an estimate. Various work was necessary, mainly to bring the vehicle up to the required standard for testing and plating.

Mr. Sorrell said he wrote to the company stating he only wanted an estimate and did not want work started on the lorry. When, in his estimation, the cost was too great he told the firm that he would take the vehicle elsewhere. W. J. Boyes told him work had already been started and to refix the lorry would cost £51 11s, which would be charged to his account. Because Mr. Sorrell refused to pay. Boyes impounded the lorry until January 9 1969.
