Which of the following most accurately describes the problem?

WHEN the Northern Licensing Authority refused a B-licence substitution application by J. Stamper (Farms), Ltd„ Dearharn, Maryport, Cumberland, his decision: was "quite unjustified." This was stated by Mr. N. L. C. Macaskie, Q.C., a member of the Transport Tribunal, when Stamper's partly succeeded in an appeal in London (The Commercial Motor, last week).

They contested the Authority's refusal of the substitution, and his refusal of an addition to another B licence. .The Tribunal agreed that the substitutionlli, should be allowed, but found that need _ had not been proved for an addition.

Mr. Macaskie said British Railways, the only objectorS, had not resisted the substitution application, and the Licensing Authority had given no valid reason for refusing to take Off one vehicle in favour of another. In the Tribunal's opinion this refusal was quite unjustified.

However, different considerations applied to ,the second part of the appeal. To justify this grant, a need -for an additional vehicle had to be proved. Mr. Stamper had tried to show that because two operators in his area had given up livestock haulage, the requirements of another 100 customers had suddenly been thrust upon him.

The Tribunal were satisfied that he had been able to cope with the extra business.

I.R.T.E. VISITS

MEMBERS of the Metropolitan area of the institute .of Road Transport Engineers will visit London Transport's works at Aldenharn on August 21, and Vauxhall Motors' factory at Luton on September 3. The East Midlands centre has planned a trip to Hepworth and Grandage, Ltd., Bradford, on September 3. The Western centre is visiting the Austin Motor Co.. Ltd., on September 17.
